NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 24 January 2018 which reads as follows:
"G.R. No. 234657 (Spouses Peter Chan and Maxima Letecia Uy Chan v. A.Y. Tantuco Manufacturing, Inc.)
After a judicious study of the case, the Court resolves to DENY the instant petition and AFFIRM the June 30, 2017 Decision 1 and October 5, 2017 Resolution 2 of the Court of Appeals (CA) in CA-G.R. CV No. 106178 for failure of petitioners Spouses Peter Chan and Maxima Letecia Uy Chan (petitioners) to sufficiently show that the CA committed any reversible error in holding them liable to pay respondent A.Y. Tantuco Manufacturing, Inc. (respondent) the value of the RBD coconut oil delivered to them.
As correctly ruled by the CA, the totality of the evidence presented sufficiently established by preponderant evidence that: (a) there was a sale on credit and actual delivery of RBD coconut oil to petitioners by respondent; (b) as acknowledgement of the deliveries, petitioners issued several checks to respondent; (c) upon presentment for payment, the checks were dishonored; and (d) despite repeated demands to pay, petitioners failed to settle their account in the total amount of P7,898,503.00. Notably, the foregoing findings involve factual issues, which, when adopted and confirmed by the CA, are generally binding and conclusive upon this Court, 3 and are not to be disturbed, unless they fall under the recognized exceptions, 4 none of which are present in this case.
