Please take notice that the Court, First Division, issued a Resolution datedDecember 3, 2018which reads as follows:
"G.R. No. 241703 — Ronnie A. Sonit and William L. Tiu, Petitioners, v. P/Supt. Elmer S. Lim and SPO1 Reynante Manulat, Respondents.
Acting on petitioners' Motion for Extension of Time to File Petition for Review on Certiorari, the Court resolves to DENY the same for lack of affidavit of service evidencing that a copy thereof was served to the Court of Appeals (CA) and to the adverse parties, as required under Section 2, Rule 45 of the Rules of Court. 1
The Court further resolves to DENY the instant Petition for Review on Certiorari for late filing; and, for lack of affidavit of service of a copy thereof to the CA and the adverse parties. 2
Let it be underscored that petitioners received a notice of the denial of their Motion for Reconsideration on August 7, 2018. As such, they had 15 days therefrom or until August 22, 2018 within which to file their petition for review on certiorari with the Court. Considering the denial of their motion for extension, the filing of the instant Petition only on September 21, 2018, was beyond the reglementary period, thus the same is dismissible for late filing. Resultantly, the assailed CA Decision and Resolution have already attained finality. HTcADC
ACCORDINGLY, the Court resolves to DENY the Petition for Review on Certiorari.
Petitioners or their authorized representative may claim from the Cash Collection and Disbursement Division their excess payment for the legal fees in the amount of P1,000.00 under Official Receipt No. 0224197-SC-EP dated September 17, 2018. CAIHTE

1. Section 2. Time for Filing; Extension. — The petition shall be filed within fifteen (15) days from notice of the judgment or final order or resolution appealed from, or of the denial of the petitioner's motion for new trial or reconsideration filed in due time after notice of the judgment. On motion duly filed and served, with full payment of the docket and other lawful fees and the deposit for costs before the expiration of the reglementary period, the Supreme Court may for justifiable reasons grant an extension of thirty (30) days only within which to file the petition.
