NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated January 23, 2019 which reads as follows:
"G.R. No. 242235 — Eduardo F. Sombito, Jr., petitioner, vs. First Tagum Rural Bank, Inc., respondent.
Acting on petitioner's Motion for Extension seeking an additional period of thirty (30) days from the expiration of the reglementary period on September 27, 2018 within which to file a Petition for Review on Certiorari, the Court resolves to DENY the same for petitioner's failure to pay the Sheriff's Trust Fund in the amount of P1,000.00.
Thus, the Petition for Review on Certiorari is hereby DENIED for late filing under Rule 45, Section 2 in relation to Rule 56, Section 5 of the Rules of Court.
Even assuming that the Court grants petitioner's Motion for Extension, the Petition must still be denied as it lacks a verified statement as to the dates of receipt of the assailed decision and of filing of the motion for reconsideration of the assailed decision in violation of Rule 45, Section 4 (b) and Section 5 in relation to Rule 56, Section 5 (d).
ACCORDINGLY, the Court resolves to DENY the instant Petition for Review on Certiorari.
