NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedJuly 2, 2018which reads as follows:
"G.R. No. 238254 (Skilled Management Corporation and Joseph P. Cruz, President v. Pedro R. Dumaguit, Jr.). — The petitioners' motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
After review, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error. The Labor Arbiter, the National Labor Relations Commission, and the CA all consistently ruled that respondent Pedro R. Dumaguit, Jr. was underpaid. Factual findings of the labor tribunals, especially if affirmed by the CA, must be given great weight, and merit the Court's respect. 1 We find no compelling reason to deviate from this general rule.
Furthermore, the Court also resolves to deny the petition due to procedural infirmities. Evidently, the petition lacks a certification of non-forum shopping, and the affidavit of service of the motion for extension to file the petition was notarized on April 16, 2018, or a day prior to the actual date of posting copies on the CA and the adverse party on April 17, 2018.
WHEREFORE, the petition is DENIED. The Decision dated January 22, 2018 and Resolution dated March 22, 2018 of the Court of Appeals in CA-G.R. SP No. 08071-MIN are AFFIRMED.
The Court of Appeals and the National Labor Relations Commission are DELETED as party respondents in this case pursuant to Sec. 4, Rule 45, 1997 Rules of Civil Procedure, as amended.
