Please take notice that the Court, Second Division, issued a Resolution dated 10 April 2013 which reads as follows:
G.R. No. 187953 (Bernard V. Sison v. Jose T. Macadaeg).
RESOLUTION
After a review of the records, the Court resolves to AFFIRM the February 13, 2009 Decision 1 and May 22, 2009 Resolution 2 of the Court of Appeals (CA) in CA-G.R. CV. No. 90376 and DENY the instant petition for failure of Bernard V. Sison (petitioner) to show that the CA committed any reversible error in upholding his liability to Jose T. Macadaeg (respondent) under their sub-contract agreement. As correctly found by the CA, EEM Petron Service Station, Inc., the party that contracted the services of petitioner for the repair of its gasoline station, was not privy to the sub-contract agreement between petitioner and respondent.
