Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedMarch 13, 2019which reads as follows:
"UDK 16359 (Junar Sindac y Villamar vs. People of the Philippines)
After a perusal of the records of the case, this Court resolves to DENY the appeal for failure of petitioner Junar Sindac y Villamar to sufficiently show any reversible error in the assailed Resolution 1 dated November 7, 2018 of the Court of Appeals which would warrant the exercise of this Court's appellate jurisdiction.
The Court also deems it proper to clarify the imposed penalty and fix the indeterminate penalty in order to make it clear and specific. CAIHTE
WHEREFORE, the appeal is DENIED. The Court of Appeals Resolution dated November 7, 2018 in CA-G.R. CR No. 39934 is AFFIRMED with MODIFICATION that petitioner Junar Sindac y Villamar is sentenced to suffer an indeterminate penalty of two (2) months and one (1) day of arresto mayor as minimum, to one (1) year and one (1) day of prision correccional as maximum.
