NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated March 11, 2019, which reads as follows:
"G.R. No. 230009 (Benildo Sena y Tejada and Bonifacio Gutierrez y Amboy v. People of the Philippines.). — The Court NOTES:
(1) the Office of the Solicitor General's Manifestation in Lieu of Comment dated May 16, 2018 stating that it has no objection to the recall of the entry of judgment made in the instant case as well as the modification of the penalty imposed against petitioners in accordance with Section 81 of R.A. No. 10951; and
(2) the transmittal letter dated May 10, 2018 of the Court of Appeals, Manila, elevating to the Court the complete records of this case.
Acting on the Motion to Recall Entry of Judgment in accordance with the provisions of R.A. No. 10951 submitted by the petitioners as well as the respondent's Manifestation in Lieu of Comment thereon, and considering that the case records do not show where petitioners are currently confined, the Court resolves to REQUIRE the counsel for the petitioners to SUBMIT within five (5) days from notice hereof the Prison Record of the petitioners, showing the locality where the petitioners-convict are confined, so as to determine to which Regional Trial Court Criminal Case No. CR-07-8703 should be remanded, for the determination of the proper penalty imposable on petitioners in accordance with In Re: Correction/Adjustment of Penalty Pursuant to Republic Act No. 10951 in Relation to Hernan v. Sandiganbayan-Rolando Elbanbuena y Marfil. 1 CAIHTE
