FIRST DIVISION
[G.R. No. 242444. January 23, 2019.]
MARIO SEGOVIA y MARAVILLA, petitioner,vs. PEOPLE OF THE PHILIPPINES, respondent.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated January 23, 2019 which reads as follows:
"G.R. No. 242444 — Mario Segovia y Maravilla, petitioner, v. People of the Philippines, respondent.
Petitioner's Motion for Extension of Time of 30 days from the expiration of the reglementary period within which to file a Petition for Review on Certiorari is GRANTED.
Considering the allegations, arguments, and issues raised, the Petition for Review on Certiorari is DENIED for failure to sufficiently show any reversible error in the assailed Decision and Resolution of the Court of Appeals (CA) as to warrant the exercise of this Court's discretionary appellate jurisdiction.
The trial court and the CA were one in the conclusion that the prosecution was able to sufficiently establish all the elements of the crimes charged. Also, as clearly illustrated by the CA, the prosecution was able to satisfactorily prove an unbroken chain of custody. It bears to stress that factual findings of the trial court when affirmed by the CA are accorded respect, if not finality, by this Court. Hence, it is not inclined to depart from the uniform findings of said lower courts.
ACCORDINGLY, the Court resolves to AFFIRM the assailed January 31, 2018 Decision 1 and September 19, 2018 Amended Decision 2 of the Court of Appeals in CA-G.R. CR-HC No. 02273.
SO ORDERED."
Very truly yours,
(SGD.) LIBRADA C. BUENADivision Clerk of Court
