"G.R. No. 236249 — Ernesto Santos, Ernesto Santiago, Herminio Sangalang, Divina Samia, Nora Ching, et al. vs. Victoria Hizon Vda. De Rodriguez and Sons, Inc., represented by its President, Reynaldo G. Rodriguez
Acting on petitioners' Motion for Extension of Time to file Petition for Review on Certiorari under Rule 45 of the Rules of Court seeking an additional period of thirty (30) days from the expiration of the reglementary period on December 19, 2017 within which to file said petition, the Court resolves to DENY the same for lack of proof of service of a copy thereof on the Court of Appeals, in violation of Rule 13, Section 13 of the Rules of Court.
With the fatal defect committed by the petitioners, the Petition for Review on Certiorari is hereby DENIED for late filing under Rule 45, Section 2 in relation to Rule 56, Section 5 of the Rules of Court.
Incidentally, even assuming that the case be ruled upon on its merits, We note that all the courts below have uniformly ruled against petitioners anent the unlawful detainer case. The Court finds no exceptional reason to disturb their conclusions.
ACCORDINGLY, the instant Petition for Review on Certiorari is hereby DENIED.
