Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated March 18, 2015 which reads as follows:
"G.R. No. 215417 (Rigid Sales Corporation v. Court of Appeals and National Water Resources Board). — Considering petitioner's motion for an extension of forty-five (45) days within which to file a petition for review on certiorari, the said petitioner is GRANTED an extension of thirty (30) days for the purpose, counted from the expiration of the reglementary period.
After a judicious review of the records, the Court resolves to DISMISS the instant petition and AFFIRM the September 10, 2014 Decision 1 and November 14, 2014 Resolution 2 of the Court of Appeals (CA) in CA-G.R. SP No. 131905 for failure of petitioner Rigid Sales Corporation to show that the CA committed grave abuse of discretion in upholding the dismissal of its complaint for lack of jurisdiction.
As correctly explained by the CA, jurisdiction over actions assailing decisions or final orders of quasi-judicial agencies such as respondent National Water Resources Board lies with the CA and not with the Regional Trial Court, in accordance with Batas Pambansa Bilang 129 and Rule 43 of the Rules of Court. 3
