Please take notice that the Court, Second Division, issued a Resolution dated16 March 2022which reads as follows: HTcADC
"G.R. No. 258625 (Francisco Reyes v. People of the Philippines). — The Court resolves to DENY the petition for review on certiorari for failure to sufficiently show any reversible error in the assailed judgment as to warrant the exercise of this Court's discretionary appellate jurisdiction in this case, and for filing the petition beyond the fifteen (15)-day reglementary period fixed in Section 2, Rule 45 in relation to Section 5 (a), Rule 56 of the Rules. Moreover, the petition failed to comply with the requirements specified in Rule 45 and other related provisions of the 2019 Amended Rules of Court as it lacks (a) a verified statement of material dates of receipt of the assailed decision and filing of the motion for reconsideration; and (b) additional attestations in the verification portion.
However, the dispositive portion of the May 19, 2021 Decision of the Court of Appeals in CA-G.R. SP No. 165924 should be modified by inserting the phrase "with subsidiary imprisonment in case of insolvency" and "per annum" as regards the application of interest. As modified, the dispositive portion of the Decision of the Court of Appeals reads as follows:
WHEREFORE, the Decision of the Regional Trial Court dated 18 February 2020 is AFFIRMED with MODIFICATION, thus: Francisco Reyes is meted the penalty of a FINE in the amount of P200.00, with subsidiary imprisonment in case of insolvency; and ordered to pay private complainant Erlinda Inocentes the amount of P1,000.00 as moral damages plus legal interest at the rate of six percent (6%) per annum from date of finality of the Decision until fully paid.
IT IS SO ORDERED.
