This is a civil case involving the Republic of the Philippines, represented by the Presidential Commission on Good Government (PCGG), against the Sandiganbayan, Eduardo Cojuangco Jr., and others. The legal issue in this case is whether the Supreme Court would grant the requests of the PCGG, such as the expungement of certain motions from the records, noting without action the returned resolutions, excusing the Process Servicing Unit from serving court notices and processes, and directing the entry of judgment in these cases in due course. The Supreme Court granted some of these requests, but not all, due to the resolution dated June 21, 2011, prohibiting the filing of further pleadings or motions in these cases.

Please take notice that the Court en banc issued a Resolution dated JANUARY 17, 2012, which reads as follows: DIAcTE

"G.R. No. 166859(Republic of the Philippines vs. Sandiganbayan [First Division], et al.); G.R. No. 169203(Republic of the Philippines vs. Eduardo M. Cojuangco, Jr., et al.); and G.R. No. 180702(Republic of the Philippines vs. Eduardo M. Cojuangco, Jr., et al.). — The Court Resolved to:

(a) EXPUNGE from the records the Urgent Omnibus Motion: (1) for Leave the File Motion to Recall the Honorable Court's Resolution Dated August 16, 2011; (2) for Leave to File and Admit the Second Motion for Reconsideration Dated August 3, 2011; and (3) to Resolve the Said Motion on the Merits dated November 4, 2011 filed by the Office of the Solicitor General for petitioner Republic of the Philippines, represented by the Presidential Commission on Good Government, in view of the resolution dated June 21, 2011 prohibiting the filing of further pleadings or motions in these cases;

(b) NOTE WITHOUT ACTION the returned resolutions dated August 9, 2011 and August 16, 2011, both addressed to Yusoph Solaiman, et al., c/o The Golden Mosque, Globo de Oro St., Quiapo, Manila, as said addressees are not parties to these cases in view of the resolution dated June 21, 2011 denying their Motion for Reconsideration with Motion to Intervene;

(c) EXCUSE the Process Servicing Unit from serving court notices and processes on Yusoph Solaiman, et al.; and

(d) NOTE WITHOUT ACTION the Letter dated December 5, 2011 filed by counsel for respondent Eduardo M. Cojuangco, Jr., et al. in G.R. No. 180702, requesting implementation of the resolutions in these cases by entering the Decision of April 12, 2011 in the book of entries of judgments, in view of the resolution dated June 21, 2011 directing the entry of judgment in these cases in due course."
