Please take notice that the Court, First Division, issued a Resolution datedNovember 20, 2017, which reads as follows: caITAC
"G.R. No. 233069 (Republic of the Philippines, represented by Hon. Hans Leo J. Cacdac in his capacity as Administrator of the Philippine Overseas Employment Administration (POEA) v. Non-Stop Overseas Employment Corporation). — There being no reversible error in the Decision of the Court of Appeals (CA) dated November 28, 2016 in CA-G.R. SP No. 138873, the petition is DENIED. The ruling of the CA affirming the Regional Trial Court (RTC), Branch 213, Mandaluyong City's denial of Republic's motion to dismiss is likewise AFFIRMED.
As ruled by the CA, the RTC correctly exercised jurisdiction over the petition filed by Non-Stop Overseas Employment Corporation (NOEC). We agree with the uniform rulings of the lower courts that the two cases filed by NOEC consist in different causes of action calling for the respective exercise of jurisdiction by the RTC and the Secretary of Labor which jurisdiction is provided by law and the Constitution. Likewise, the causes of action and the reliefs sought by NOEC in the separate cases are different which negates forum shopping. Recently, on the very same factual circumstances and issue, the Supreme Court, in Republic v. Principalia Management and Personnel Consultants, Inc., 1 definitively ruled that the RTC can take cognizance of the injunction complaint, "a suit which has for its purpose the enjoinment of the defendant, perpetually or for a particular time, from the commission or continuance of a specific act, or his compulsion to continue performance of a particular act." 2
