Please take notice that the Court, Second Division, issued a Resolution dated 04 February 2019 which reads as follows:
"G.R. No. 238107 (Republic of the Philippines v. Maricor Alquisola, for herself and as Attorney-in-Fact of Gregorio Saad, Nena S. Cuaresma, Paramon B. Saad, and Tita B. Saad)
After a judicious study of the case, the Court resolves to DENY the instant petition 1 and AFFIRM the September 26, 2017 Decision 2 and the February 28, 2018 Resolution 3 of the Court of Appeals (CA) in CA-G.R. CV No. 05875 for failure to sufficiently show that the CA committed any reversible error in upholding the December 3, 2015 Order 4 of the Regional Trial Court of Dumaguete City, Branch 38 (RTC) ordering the correction of the area of Lot 3 in Transfer Certificate of Title (TCT) No. 103-2014000062 5 from 5,665 square meters to 5,695 square meters, as well as the technical description thereof. 6
As correctly ruled by the CA, the corrections sought in this case are merely typographical, involving as it does only the amendment of erroneous data inscribed in TCT No. 103-2014000062, all of which had been duly acknowledged and admitted by the representative of the Land Management Services-Department of Environment and Natural Resources Region VII who, in fact, recommended such corrections. 7 As such, the adjoining owners of the property covered by TCT No. 103-2014000062 need not be notified of the petition, there being no rights or interests that will be affected thereby. 8 Accordingly, the present petition must be denied.
