Please take notice that the Court, Second Division, issued a Resolution dated 07 November 2018 which reads as follows:
"G.R. No. 240607 — Michael G. Regudo versus New RBW Marketing, Inc.
After reviewing the Petition and its annexes, including the Decision 1 dated November 22, 2017 and Resolution 2 dated May 17, 2018, of the Court of Appeals (CA) Tenth Division and Former Tenth Division, respectively, in CA-G.R. SP No. 145933, the Court RESOLVES to DENY the instant Petition and AFFIRM the said rulings of the CA.
The CA committed no reversible error in reversing and setting aside the Decision dated January 21, 2016 and Resolution dated March 31, 2016 of the National Labor Relations Commission and modifying the Decision dated October 15, 2015 of the Labor Arbiter by reducing petitioner's award to the amount of Nine Thousand Seven Hundred Eleven Pesos and Eighty-Six Centavos (P9,711.86) representing his pro-rated 13th month pay for the year 2014. The award of 13th month pay for the years prior to 2014 was without any basis as such was never claimed in petitioner's complaint and respondent was not given an opportunity to address the same.
