Please take notice that the Court en banc issued a Resolution dated JANUARY 22, 2013, which reads as follows:
"G.R. No. 204828(Jaime C. Regio v. The Commission on Elections and Ronnie C. Co).
RESOLUTION
Acting on Jaime C. Regio's Petition for Certiorari dated January 2, 2013, the Court, without necessarily giving due course to the petition, resolves to require respondents to COMMENT on the petition (not to file a motion to dismiss) within ten (10) days from notice.
Anent petitioner's prayer for the issuance of a "Temporary Restraining Order/Status Quo Ante Order enjoining respondent Commission on Elections [COMELEC] En Banc from enforcing the Resolution in EAC (BRGY-SK) No. 161-2011 promulgated on December 7, 2012, and from further continuing any act or proceeding relevant to, or arising out of, or in connection with the same," in relation to his Petition for Certiorari, and in view of the availability of the remedy of execution pending appeal, the Court resolves to issue a TEMPORARY RESTRAINING ORDER (TRO) enjoining respondent COMELEC from enforcing its Resolution dated December 7, 2012 and from conducting any further action or proceeding in relation to the aforementioned case. The TRO shall be effective immediately until further orders from the Court." Brion, J., on official leave. (adv58) EASCDH
