NOTICE
Sirs/Mesdames :
Please take notice that the Court en banc issued a Resolution dated FEBRUARY 5, 2013, which reads as follows:
"A.M. No. 2012-05-SC (RE: Letter-Complaint of Ms. Suzette C. Cruz, Utility Worker II, Office of Justice Presbitero J. Velasco, Jr., against Mr. Christopher A. Galimba, Watchman II, Security Division, Office of Administrative Services). — Before this Court is the Memorandum dated June 26, 2012 issued by Atty. Eden T. Candelaria, Deputy Clerk of Court and Chief Administrative Officer, Office of the Administrative Services (OAS), which found both complainant Suzette C. Cruz (Cruz) and respondent Christopher A. Galimba, guilty of Disgraceful and Immoral Conduct, and recommended the penalty of suspension from service for five (5) days.
After a careful perusal of the findings and recommendations of the OAS, however, the Court resolved to adopt the same, except the penalty imposed against Cruz. We note that Cruz was the one who filed the instant complaint and had it not been for her, the wrongdoings committed by respondent would have remained unpunished. Thus, while we do not dispute the findings of administrative liability upon Cruz, we deem it proper, however, to mitigate the same. EcASIC
ACCORDINGLY, in the exercise of this Court's discretion to temper the harshness of its judgment with mercy, and to encourage court employees to report wrongdoings, we resolve instead that complainant Suzette C. Cruz be ADMONISHED to be more circumspect in the conduct of her personal deportment.
As to the complaint for non-payment of debts against respondent Christopher A. Galimba, the same is DISMISSED for lack of sufficient evidence. However, respondent, having been found GUILTY of Disgraceful and Immoral Conduct, the penalty of SUSPENSION from service for five (5) days is imposed upon him.
Moreover, both complainant and respondent are likewise sternly WARNED that a repetition of the same or similar acts in the future will be dealt with more severely." (adv18)
