"G.R. No. 239198 (Franklino Ramos v. People of the Philippines). — The petitioner's motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
There being no reversible error in the Resolution of the Court of Appeals (CA) dated September 7, 2017 in CA-G.R. CR No. 40171, the petition is DENIED.
The CA correctly dismissed the petition of Franklino Ramos for being filed out of time and ruling that his appeal was not perfected in the manner and period set by law. Indeed, failure to perfect an appeal according to the rules renders the judgment sought to be appealed from final and executory.
WHEREFORE, the petition is DENIED. The Resolution of the Court of Appeals dated September 7, 2017 in CA-G.R. CR No. 40171 is AFFIRMED.
