NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated06 April 2022which reads as follows:
"G.R. No. 258165 (Salve Ramirez a.k.a. "Rizza Ramos, Rizzerfina Ramos, Rizza Damo, and Rizzerfina Damo" vs. People of the Philippines). — After a review of the records, the Court resolves to DENY the Petition for Review on Certiorari1 for failure of petitioner Salve Ramirez a.k.a. Rizza Ramos, Rizzerfina Ramos, Rizza Damo, and Rizzerfina Damo (petitioner) to sufficiently show that the Court of Appeals (CA) in CA-G.R. CR No. 43828 committed any reversible error in its Decision 2 dated 29 October 2020 and Resolution dated 19 July 2021 to warrant the exercise of the Court's appellate jurisdiction.
As correctly ruled by the Regional Trial Court and affirmed by the CA, the prosecution was able to establish petitioner's guilt beyond reasonable doubt for Illegal Recruitment and two (2) counts of Estafa. However, pursuant to Nacar v. Gallery Frames, 3 there is a need to modify the period to reckon with as to the six percent (6%) legal interest imposed upon the moral damages awarded, i.e., from finality of the resolution until full payment thereof.
WHEREFORE, the 29 October 2020 Decision and the Resolution dated 19 July 2021 of the Court of Appeals in CA-G.R. CR No. 43828 is AFFIRMED with MODIFICATIONS in that the six percent (6%) legal interest imposed upon the moral damages awarded is reckoned from the finality of the resolution until full payment thereof.
Moreover, the Court resolves to:
1. GRANT the motion of petitioner for extension of 30 days from the expiration of the reglementary period within which to file a petition for review on certiorari; and aScITE
2. NOTE the manifestation dated 24 September 2021 of the Public Attorney's Office, stating that based on their records, petitioner has no pending and/or subsequent filing of any case involving the same parties and issues, apart from the case before the Court of Appeals docketed as CA-G.R. CR No. 45765 entitled "People of the Philippines vs. Salve Ramirez a.k.a. Reserfina Damo a.k.a. Risa Damo"; and that on 23 September 2021, counsel filed and served via registered mail the petition in the instant case dated 31 August 2021.
