Please take notice that the Court, Second Division, issued a Resolution dated 20 March 2013 which reads as follows:
G.R. No. 195847 (Radio Philippines Network, Inc., (RPN), President Mia Concio, General Manager Leonor Linao, Human Resource Department Manager Lourdes Angeles, and Assistant General Manager for Finance Ida Barromeda v. Michael De Castro).
After a judicious review of the records, the Court resolves to AFFIRM the November 4, 2010 Decision 1 and February 17, 2011 Resolution 2 of the Court of Appeals (CA) in CA-G.R. SP No. 107614 and DENY the instant petition for failure of Radio Philippines Network (RPN) to show that the CA committed any reversible error in ruling that it illegally dismissed Michael De Castro (De Castro).
As correctly ruled by the CA, RPN's Investigative Panel itself admitted that it merely brokered a reconciliation between De Castro and Radio Philippines Network Employees' Union (RPNEU) under the guise of conducting a separate investigation. Thus, RPN failed to conduct a true and separate investigation to determine the veracity and sufficiency of the circumstances surrounding De Castro's expulsion from RPNEU. Absent such a determination, RPN cannot claim that it had terminated the employment of De Castro for just cause. 3
