NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedJuly 4, 2018which reads as follows:
"G.R. No. 238582 (Race Ventures, Inc. v. Manolito C. Medina). — There being no reversible error in the Decision dated January 31, 2017 and Resolution dated March 27, 2018 of the Court of Appeals (CA) in CA-G.R. SP No. 136051, and considering that affiant Paul Lawrence S. Lim lacks proof of authority to cause the preparation of the petition and to sign its verification and certification on non-forum shopping, the petition is DENIED.
The CA correctly affirmed the National Labor Relation Commission's ruling that Race Ventures, Inc. did not comply with procedural due process when it failed to provide Manolito C. Medina (Medina) reasonable opportunity to respond to its letter charging Medina with a company offense. Likewise, the CA correctly increased the award of nominal damages from P5,000.00 to P30,000.00 consistent with prevailing jurisprudence. 1 HTcADC
WHEREFORE, the petition is DENIED. The Decision and Resolution of the Court of Appeals in CA-G.R. SP No. 136051 are AFFIRMED.
