Please take notice that the Court, First Division, issued a Resolution datedJune 27, 2018which reads as follows:
"G.R. No. 238943 — Jesus Orlando M. Quiñones vs. Office of the Ombudsman, Ruvi Jean Villagomez Cariño, Romeo S. Tayo, and Cyril Contreras-Manzano
After carefully reviewing the allegations, issues, and arguments adduced in the instant Petition for Certiorari, the Court notes that: (1) the petition lacks verified statement as to the date of filing of motion for reconsideration of the assailed decision; (2) the petition also lacks P1,000.00 for Sheriff's Trust Fund per A.M. 17-12-09-SC and P100.00 for deposit for Sheriff's Fee, since the amount remitted was only P3,730.00; and, (3) the petitioner availed of the wrong remedy. It is settled that appeals from the decisions of the Office of the Ombudsman in administrative disciplinary cases should be appealed to the Court of Appeals under Rule 43 of the Rules of Court. It is only in criminal cases where the aggrieved party may file an original petition for certiorari under Rule 65 before this Court on the ground that the findings of the Office of the Ombudsman were tainted with grave abuse of discretion amounting to lack or in excess of jurisdiction. In this case, the petitioner availed of a wrong remedy when he filed his Petition for Certiorari before this Court despite the fact that the appealed decision involved an administrative disciplinary case. On this ground alone, the petition should be dismissed outright.
ACCORDINGLY, the Court resolved to DISMISS the instant Petition for Certiorari.
