NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution datedMarch 9, 2020, which reads as follows:
"G.R. No. 250052 (BONIFACIO QUEZON Y HIPOLITO, petitioner v. PEOPLE OF THE PHILIPPINES, respondent). — After considering the allegations, issues, and arguments adduced in the Petition for Review on Certiorari assailing the Court of Appeals' Decision and Resolution in CA-G.R. CR No. 41546, this Court resolves to DENY the petition for failure to show any reversible error in the assailed judgments as to warrant the exercise of this court's discretionary appellate jurisdiction. HTcADC
However, in view of this Court's ruling in People v. Tulagan1 as to the proper amount of damages, the dispositive portion of the assailed decision is MODIFIED.
WHEREFORE, the findings of fact and conclusions of law of the Court of Appeals are AFFIRMED with MODIFICATION. Petitioner Bonifacio Quezon is found GUILTY beyond reasonable doubt of lascivious conduct under Section 5 (B) of Republic Act No. 7610 and is sentenced to suffer the indeterminate penalty of twelve (12) years and one (1) day of reclusion temporal, as minimum, to fifteen (15) years, six (6) months, and twenty-one (21) days of reclusion temporal as maximum. Moreover, he is ordered to pay private respondent civil indemnity, moral damages, and exemplary damages amounting to P50,000.00 each and the costs of the suit. In line with current jurisprudence, interest at the rate of six percent (6%) per annum should be imposed on all monetary awards from the date of the finality of this judgment until fully paid. 2
