"G.R. No. 237025 — Atty. Teodulo M. Punzalan v. Spouses Dominador Bundang and Aurora Bundang
Petitioner's Motion for Extension of Time of 15 days from the expiration of the reglementary period within which to file a Petition for Review on Certiorari is GRANTED.
Considering the allegations, arguments, and issues raised, the Petition for Review on Certiorari is DENIED for failure of the petitioner to sufficiently show any reversible error in the assailed Decision and Resolution as to warrant the exercise of this Court's discretionary appellate jurisdiction.
Petitioner's main argument is that there was no oral contract of sale entered into by and between him and respondents. Suffice it to state, however, that this issue involves a question of fact which is beyond the ambit of a Rule 45 petition. 1 At any rate, the Regional Trial Court and the Court of Appeals (CA) are one in their conclusion as to the existence of an oral contract of sale between the parties. "It is well-settled that when the trial court's factual findings have been affirmed by the CA, the findings are generally conclusive and binding upon the Court and may no longer be reviewed on Rule 45 petitions." 2
ACCORDINGLY, the Court resolves to AFFIRM the assailed August 16, 2017 Decision 3 and January 25, 2018 Resolution 4 of the Court of Appeals in CA-G.R. CV No. 107275.
