Please take notice that the Court, Third Division, issued a Resolution dated23 April 2012, which reads as follows:
G.R. No. 200711 (Ronald B. Pulmon, Romeo L. Sulayao, Joemar G. Rodriguez, Rudy C. Franco, Nonoy N. Perol, Reynaldo B. Montilla, Jose L. Magalona, Joseph Magalona, Darwin G. Galangue, Angelito G. Santos, Ricky G. Presilda and Ariel G. Presilda, v. J.P. Gacula Construction/Jeff P. Gacula).
RESOLUTION
After a careful evaluation of the records, the Court resolves to DENY the instant petition for failure to show that the Court of Appeals committed reversible error in setting aside the decision of the National Labor Relations Commission and in finding petitioners Ronald B. Pulmon, Romeo L. Sulayao, Joemar G. Rodriguez, Rudy C. Franco, Nonoy N. Perol, Reynaldo B. Montilla, Jose L. Magalona, Joseph Magalona, Darwin G. Galangue, Angelito G. Santos, Ricky G. Presilda and Ariel G. Presilda to be project employees of respondents J.P. Gacula Construction/Jeff P. Gacula. Records show that respondents merely hired petitioners for specific projects secured from Manila Water, of which, respondent company is an accredited contractor. As aptly pointed out by the appellate court, length of service, or the re-hiring of construction workers on a project basis, does not confer upon them regular employment.
Moreover, the jurat of the verification and certification against forum shopping of the instant petition lacks petitioners-affiants' current identification documents issued by an official agency bearing their photographs and signatures, in violation of Sections 2, 6 and 12, Rule II of the 2004 Rules on Notarial Practice, as amended by A.M. No. 02-8-13-SC dated February 19, 2008. AcSCaI
