Please take notice that the Court, First Division, issued a Resolution datedOctober 17, 2018which reads as follows:
"UDK 16263 — Jonathan Poblacion, Petitioner, v. People of the Philippines, Respondent.
This Court resolves to DENY petitioner Jonathan Poblacion's Motion for Extension of Time to File Petition for Review on Certiorari under Rule 45 of the Rules of Court seeking for an additional period of thirty (30) days from the expiration of the reglementary period on July 19, 2018 within which to file Petition for Review on Certiorari for: (1) the timeliness of said Motion for Extension cannot be determined since the date of posting was not clearly indicated in the registry receipt stamps; (2) lack of payment of docket and other legal fees, in violation of Sections 3 and 5 of Rule 45, in relation to Section 5 (c) of Rule 56, of the Rules of Court; and (3) lack of affidavit of service thereof to the Court of Appeals and adverse party in violation of Section 13 of Rule 13, in relation to Section 2 of Rule 45 of the Rules of Court.
ACCORDINGLY, this Court further resolves to DENY the instant Petition for Review on Certiorari for late filing. Besides, said Petition: (1) lacks a verified statement as to the date of filing of the motion for reconsideration of the assailed decision in violation of Section 2, Rule 45 of the Rules of Court; (2) lacks proof of authority of affiant, Robert J. Parcon, to sign the Verification and Certification Against Forum Shopping of the petition for and on behalf of petitioner in violation of Sections 1 and 4, Rule 45, in relation to Sections 4 and 5, Rule 7, of the Rules of Court; and (3) lacks an explanation why the service of the Petition for Review on Certiorari to the Court of Appeals and to the adverse party were not done personally in violation of Section 3, Rule 45, in relation to Section 11, Rule 11, of the Rules of Court.
