NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated03 April 2019which reads as follows:
"G.R. No. 241903 — Francisco "Francis" R. Pizarra versus People of the Philippines
After reviewing the Petition and its annexes, inclusive of the Decision 1 dated August 14, 2017 and Resolution 2 dated July 13, 2018 of the Court of Appeals (CA) in CA-G.R. CR No. 37926, the Court resolves to DENY the same for failure to show reversible error on the part of the CA.
The Court notes that petitioner wholly anchors his Petition on factual issues. In particular, he raises the following: (i) that the trial court erred in overly relying on the testimony of the private complainant; (ii) that the trial court erred in disregarding his testimony; and (iii) that the trial court erred in finding the private complainant's testimony credible. Such issues, however, are impermissible in an appeal by certiorari, which is limited to questions of law only. While questions of fact have been entertained in justifiable circumstances, the Court finds that petitioner herein failed to establish that the instant case falls within the allowable exceptions.
Be that as it may, the Court finds no reversible error committed by the CA in affirming petitioner's guilt for Grave Coercion under Article 286 of the Revised Penal Code. All the elements constituting such crime are sufficiently supported by the evidence on record, as uniformly held by the inferior courts.
