G.R. No. 198663 (Notice)

This is a criminal case, People of the Philippines v. Reginald Yap y Viola alias "Particles Yap" (G.R. No. 198663, December 2, 2015). The Supreme Court dismissed the appeal for failure to show any reversible error in the Court of Appeals' decision finding Reginald Yap guilty beyond reasonable doubt of violating Section 5, Article II of Republic Act No. 9165 (Illegal Sale of Dangerous Drugs). Yap was sentenced to suffer the penalty of life imprisonment and pay a fine of PhP 500,000 without subsidiary imprisonment in case of insolvency. The Supreme Court adopted the findings and conclusions of law in the Court of Appeals Decision dated January 31, 2011 in CA-G.R. HC-CR No. 00624-MIN.

Please take notice that the Court, Third Division, issued a Resolution dated December 2, 2015, which reads as follows:

"G.R. No. 198663 — (People of the Philippines v. Reginald Yap y Viola alias "Particles Yap"). — Considering the issues and arguments presented in the Appellant's and the Appellee's Briefs, as well as the former's Reply and Supplementary Appeal Briefs, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated January 31, 2011 as to warrant the exercise of the Court's appellate jurisdiction. ATICcS

IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Court of Appeals Decision dated January 31, 2011 in CA-G.R. HC-CR No. 00624-MIN, and AFFIRMS the said Decision finding Reginald Yap y Viola alias "Particles Yap" guilty beyond reasonable doubt of the crime of violation of Section 5, Article II of Republic Act No. 9165, and sentencing him to suffer the penalty of life imprisonment and to pay the FINE of P500,000.00 without subsidiary imprisonment in case of insolvency.
