NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated January 14, 2019 which reads as follows:
"G.R. No. 234610 (People of the Philippines v. Crisanto Macana Dangoy, et al., accused; Antonio Daba Yabut and Ruben Reyes Lepaopao, accused-appellants.). — After review, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in upholding Crisanto Macana Dangoy, Rosalito Macana Dangoy, Ruben Onihog Arejas, Allan Arejas Fernandez (all detained), and Antonio Daba Yabut and Ruben Reyes Lepaopao's guilt beyond reasonable doubt for the crime of 12 counts of rape with homicide. The CA is correct in upholding the lower court's Decision that all the requirements for a valid confession had been fulfilled in this case. Besides, accused-appellants have not presented any evidence of compulsion to support their claim of force and intimidation in the execution of their confessions. We also agree with the CA in dismissing the charges of illegal possession of firearms against Allan Arejas Fernandez, Rosalito Macana Dangoy, and Crisanto Macana Dangoy, by virtue of the amendments introduced by Republic Act No. 8294 to Presidential Decree 1866.
We, however, modify the amounts of the civil indemnity and damages awarded to the heirs of the deceased-victims. In conformity with existing jurisprudence, accused-appellants are adjudged to pay the amounts of P100,000.00 as civil indemnity, P100,000.00 as moral damages, and P100,000.00 as exemplary damages to the heirs of the deceased-victims. Accused-appellants are also ordered to pay interest at a rate of 6% per annum from the time of finality of this Resolution until fully paid, to be imposed on the civil indemnity, moral damages, and exemplary damages.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated February 21, 2017 of the Court of Appeals in CA-G.R. CR-HC No. 00445-MIN, and AFFIRMS said Decision finding accused-appellants GUILTY beyond reasonable doubt of 12 counts of rape with homicide, and sentencing them to suffer the penalty of 12 reclusion perpetua each, without eligibility for parole, and to pay the heirs of the deceased-victims the amounts of P100,000.00 as civil indemnity, P100,000.00 as moral damages, and P100,000.00 as exemplary damages. Accused-appellants are also ordered to pay interest at a rate of 6% per annum from the time of finality of this Resolution until fully paid, to be imposed on the civil indemnity, moral damages, and exemplary damages.
