PEOPLE OF THE PHILIPPINES, plaintiff-appellee, vs. ALLAN YABES Y YORO, accused-appellant.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated October 16, 2013, which reads as follows:
"G.R. No. 206833 (People of the Philippines v. Allan Yabes y Yoro). — The records of this case were elevated to this Court on May 14, 2013, pursuant to the May 22, 2012 Resolution of the Court of Appeals, which gave due course to the notice of appeal filed by the accused, Allan Yabes y Yoro.
The Court resolves to:
(1) NOTE the Letter, dated August 19, 2013, of P/Supt. IV Venancio J. Tesoro, Superintendent, New Bilibid Prison, Bureau of Corrections, confirming the confinement of the accused therein since April 7, 2010;
(2) NOTE the Manifestation (In Lieu of Supplemental Brief), dated August 29, 2013, filed by the Office of the Solicitor General, that it opted to dispense with the filing of a supplemental brief as it had sufficiently discussed and amplified its position in the case in its appellee's brief; DHSACT
(3) NOTE the Manifestation (In Lieu of Supplemental Brief), dated September 16, 2013, filed by the accused that he would no longer file a supplemental brief in view of the exhaustive discussion of the assigned errors in the appellant's brief, dated January 21, 2011, and, thus, he is adopting the appellant's brief as his supplemental brief; and
(4) DISMISS the appeal of the accused for his failure to sufficiently show reversible error in the challenged decision warranting the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court AFFIRMS the March 30, 2012 Decision of the Court of Appeals in CA-G.R. CR-HC No. 04611, finding Allan Yabes y Yoro GUILTY beyond reasonable doubt of the crime of Parricide defined and penalized under Article 246 of the Revised Penal Code, as amended, and sentencing him to suffer the penalty of reclusion perpetua and to pay the offended party the amount of Fifty Thousand Pesos (P50,000.00) as civil indemnity, Fifty Thousand Pesos (P50,000.00) as moral damages, and Thirty Thousand Pesos (P30,000.00) as exemplary damages.
