PEOPLE OF THE PHILIPPINES, plaintiff-appellee, vs. ARMANDO G. WENCESLAO, accused-appellant.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated July 19, 2017, which reads as follows:
"G.R. No. 207230 (People of the Philippines, Plaintiff-Appellee vs. Armando G. Wenceslao, Accused-Appellant). — The records of this case were elevated to this Court pursuant to the Resolution 1 dated April 19, 2013 of the Court of Appeals (CA) which gave due course to Armando G. Wenceslao's (accused-appellant) Notice of Appeal.
On July 31, 2013, this Court issued a Resolution 2 wherein it notified both parties to file their respective supplemental briefs. In lieu, however, thereof, the Public Attorney's Office filed a Manifestation 3 wherein it stated that it is adopting in toto the contents and substance of its Appellant's Brief filed in the CA. Also, the Office of the Solicitor General filed its Manifestation 4 wherein it submitted that it adopts and repleads its Appellee's Brief filed in CA in lieu of Supplemental brief.
After a perusal of the records of the case, this Court resolves to DISMISS the appeal for failure of accused-appellant Wenceslao to sufficiently show any reversible error in the assailed Decision 5 dated September 18, 2012 of the CA in CA-G.R. CR-H.C. No. 00929 which would warrant the exercise of this Court's appellate jurisdiction.
In view of current jurisprudence, however, this Court modifies the award of damages by increasing the amount of civil indemnity to P100,000.00 and moral damages to P100,000.00. Likewise, the Court grants exemplary damages to AAA in the amount of P100,000.00. 6
In addition, this Court also imposes on all the monetary awards for damages interest at the legal rate of six percent (6%) per annum from the date of finality of this Decision until fully paid. 7
WHEREFORE, the appeal is DISMISSED. The Decision dated September 18, 2012 of the Court of Appeals in CA-G.R. CR-H.C. No. 00929 is AFFIRMED with MODIFICATION that accused-appellant Armando G. Wenceslao is ordered to pay private complainant P100,000.00 as civil indemnity, P100,000.00 as moral damages, and P100,000.00 as exemplary damages. In addition, all monetary awards for damages shall earn interest at the legal rate of six percent (6%) per annum from date of finality of this Resolution until fully paid.
SO ORDERED."
