NOTICE

Please take notice that the Court, Third Division, issued a Resolution dated April 13, 2016, which reads as follows:
"G.R. No. 215717 (People of the Philippines vs. Alejandro Soledad y Callet @ "Ayik" and Randy Recede y Perez). — After an exhaustive review of the allegations, issues and arguments presented by the parties, the Court resolves to DISMISS the appeal for failure to sufficiently prove that the Court of Appeals committed a reversible error in its disputed Decision dated April 25, 2014 as to warrant the exercise of the Court's discretionary appellate jurisdiction.
WHEREFORE, PREMISES CONSIDERED, the Court adopts the findings of fact and conclusions of law of the Court of Appeals in its Decision dated April 25, 2014 finding accused-appellants Alejandro Soledad y Callet @ "Ayik" and Randy Recede y Perez GUILTY beyond reasonable doubt of violating Sections 5 and 11, Article II of Republic Act No. 9165. In Criminal Case No. 19649, Alejandro Soledad y Callet @ "Ayik" is sentenced to suffer an indeterminate penalty of imprisonment of twelve (12) years and one (1) day, as minimum, to fourteen (14) years, as maximum, and to pay a fine of P400,000.00. In Criminal Case No. 19651, he is sentenced to suffer life imprisonment and to pay a fine of P500,000.00. In Criminal Case No. 19650, Randy Recede y Perez is sentenced to suffer an indeterminate penalty of twelve (12) years and one (1) day, as minimum, to fourteen (14) years, as maximum, and to pay a fine of P400,000.00."
