NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution datedJuly 1, 2019, which reads as follows:
"G.R. No. 238826 (People of the Philippines v. Jeffrey Silaran y Amistad). — Considering the allegations, issues and arguments presented in the Appellant's and the Appellee's Briefs, which the parties adopted instead of filing their respective Supplemental Appeal Briefs, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated January 12, 2018, as to warrant the exercise of the Court's discretionary appellate jurisdiction. HTcADC
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated January 12, 2018 of the Court of Appeals in CA-G.R. CR HC No. 09075, and AFFIRMS the said Decision finding appellant Jeffrey Silaran y Amistad guilty beyond reasonable doubt of Rape, as defined under Article 266-A, paragraph 1 (a) and penalized under Article 266-B of the Revised Penal Code, as amended, and sentencing him to suffer the penalty of reclusion perpetua, with MODIFICATION, ordering appellant to pay the victim the amounts of P75,000.00 as civil indemnity, P75,000.00 as moral damages and P75,000.00 as exemplary damages, with legal interest at the rate of six percent (6%) per annum on all damages awarded from the date of finality of this Resolution until fully paid, in line with People v. Jugueta. 1
