Please take notice that the Court, Third Division, issued a Resolution datedAugust 28, 2019, which reads as follows:
"G.R. No. 229929 (People of the Philippines v. Eugene Bancairen Serencio). — Considering all the allegations, issues and arguments presented in the appeal, this Court resolves to DISMISS the appeal for failure to sufficiently prove that the Court of Appeals committed any reversible error in its assailed Decision dated September 29, 2016, as to warrant the exercise of the Court's discretionary appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated September 29, 2016 of the Court of Appeals in CA-G.R. CEB-CR-HC No. 02108 and AFFIRMS the Decision in Criminal Case No. 2014-22640, finding accused-appellant Eugene Bancairen Serencio guilty beyond reasonable doubt of violation of Section 5, Article II of Republic Act No. 9165 and sentencing him to suffer the penalty of life imprisonment and to pay a fine of Five Hundred Thousand Pesos (P500,000.00).
