NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 09 September 2020 which reads as follows:
"G.R. No. 236832 (People of the Philippines v. Julie Seguera y Irinco). — The records of this case were elevated to this Court on February 9, 2018, pursuant to the Court of Appeal's (CA) Resolution 1 dated December 4, 2017, which gave due course to the Notice of Appeal filed by Julie Seguera y Irinco (accused-appellant).
In compliance with the Court's Resolution dated March 12, 2018, both parties filed their respective Manifestations: (a) Manifestation 2 dated June 18, 2018 of the Office of the Solicitor General, stating that it will no longer file a supplement to its Appellee's Brief, considering that the issues in their case had already been sufficiently and exhaustively discussed by the appellee and argued in its appellee's brief dated April 26, 2017; and (b) Motion to Admit Manifestation 3 dated July 4, 2018 of the accused-appellant, through the Public Attorney's Office-Regional Special and Appealed Cases Unit-Cebu, stating that the filing of a Supplemental Brief would only result to a reiteration of all the arguments already exhaustively discussed in his Appellant's Brief.
After a judicious review of the records of this case, the Court resolves to DISMISS the appeal for failure of the accused-appellant to sufficiently show reversible error in the assailed CA Decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusion of law in the Decision dated August 24, 2017 of the Court of Appeals in CA-G.R. CEB-CR HC No. 02295, finding herein Julie Seguera y Irinco guilty beyond reasonable doubt of Rape under paragraph 1 (d) of Article 266-A and penalized under the first paragraph of Article 266-B of the Revised Penal Code, as amended, and AFFIRMS said Decision in toto.
