Please take notice that the Court, Second Division, issued a Resolution dated26 April 2017which reads as follows: HTcADC
"G.R. No. 207660: THE PEOPLE OF THE PHILIPPINES v. ROSARIO SARINAS y CANCIO
Through its Resolution 1 dated January 8, 2013, the Court of Appeals elevated the records of this case to this Court on July 5, 2013. 2 The Resolution gave due course to the Notice of Appeal filed by accused-appellant, Rosario Sarinas y Cancio (Sarinas).
In the Resolution 3 dated September 2, 2013, this Court noted the records of the case forwarded by the Court of Appeals. The parties were then ordered to file their supplemental briefs, should they so desire, within 30 days from notice.
On October 23, 2013, the Office of the Solicitor General filed a Manifestation on behalf of the People of the Philippines, stating that it would no longer file a supplemental brief. 4 A similar Manifestation 5 was filed by the Public Attorney's Office on February 10, 2014 on behalf of accused-appellant Sarinas.
After evaluating the records of this case, this Court resolves to AFFIRM the assailed Court of Appeals Decision as accused-appellant Sarinas failed to show any reversible error in the challenged Decision warranting the exercise of this Court's appellate jurisdiction.
WHEREFORE, the findings of fact and conclusions of law of the Court of Appeals are AFFIRMED. Accused-appellant, Rosario Sarinas y Cancio is found guilty beyond reasonable doubt of qualified theft, punishable under Article 310 in relation to Article 309 (1) of the Revised Penal Code. Accused-appellant Sarinas is sentenced to suffer the penalty of reclusion perpetua and its accessory penalties under Article 41 of the Revised Penal Code.
Further, accused-appellant Sarinas is ordered to pay Metrobank the sum of US$10,043.52 as actual damages, which shall earn interest at the rate of six percent (6%) per annum from finality of the resolution until full payment. 6
