NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated June 19, 2017, which reads as follows:
"G.R. No. 225056 (People of the Philippines vs. Jose Sanico y Sta. Iglesia). — This is an appeal pursuant to Section 13 (c) of Rule 124 of the Revised Rules of Criminal Procedure seeking the reversal of the Decision 1 dated May 25, 2015 issued by the Court of Appeals (CA) in CA-G.R. CR-HC No. 05149.
After a judicious review of the records of this case, the Court resolves to DISMISS the instant appeal for failure of accused-appellant Jose Sanico y Sta. Iglesia to sufficiently show any reversible error in the assailed CA decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS and AFFIRMS the factual findings and conclusions of law of the Court of Appeals in its Decision dated May 25, 2015 in CA-G.R. CR-HC No. 05149, holding accused-appellant Jose Sanico y Sta. Iglesia guilty beyond reasonable doubt of the crime of Murder defined and penalized under Article 248 of the Revised Penal Code. However, to conform with prevailing jurisprudence, 2 the amounts awarded representing moral damages, civil indemnity, and exemplary damages are hereby MODIFIED, in that the respective amounts for said damages are evenly fixed at P100,000.00 each. (Jardeleza, J., no part due to his prior action in the Office of the Solicitor General; Leonen, J., designated additional Member per Raffle dated July 4, 2016; Tijam, J., no part due to his prior action as ponente of the assailed CA decision; Leonardo-de Castro, J., designated additional Member per Raffle dated June 14, 2017.)
