NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated January 10, 2019 which reads as follows:
"G.R. No. 237354 (People of the Philippines v. Ronald Sambalilo y Velasco). — After review, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in upholding Ronald Sambalilo y Velasco's conviction of violating Sections 5 and 11, Article II of Republic Act No. 9165, otherwise known as the Comprehensive Dangerous Drugs Act of 2002.
The CA is correct in upholding the lower court's Decision that all the elements for the delivery and possession of illegal drugs have been proved in this case. The testimonies and the evidence offered by the prosecution were the basis of the CA in affirming the conviction of appellant, whose defense of denial and frame up had remained uncorroborated.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated August 31, 2017 of the Court of Appeals in CA-G.R. CR-HC No. 08179, and AFFIRMS said Decision finding accused-appellant Ronald Sambalilo y Velasco GUILTY beyond reasonable doubt of violation of Sections 5 and 11, Article II of Republic Act No. 9165, and sentencing him to suffer the penalty of life imprisonment, without eligibility of parole, plus a fine of P500,000.00 for violation of Section 5, and imprisonment of twelve (12) years and one (1) day as minimum to fourteen (14) years and eight (8) months as maximum plus a fine of P300,000.00 for violation of Section 11.
