NOTICE
Sirs/Mesdames :
Please take notice that the Court, Special Second Division, issued a Resolution dated27 November 2019which reads as follows:
"G.R. No. 242634 (People of the Philippines vs. Ryan Salvador y Jasinillias). — The Court NOTES the Office of the Solicitor General's:
1. manifestation in lieu of supplemental brief dated August 29, 2019 of the Office of the Solicitor General, dispensing with the filing of supplemental brief, and repleading and adopting the arguments in its appellee's brief as its supplemental brief in this case; and
2. manifestation dated November 11, 2019 in compliance with the Resolution dated August 14, 2019, stating that its manifestation in lieu of supplemental brief was already filed last August 30, 2019.
After a judicious review of the records, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in upholding the conviction of accused-appellant Ryan Salvador y Jasinillias for committing the crime of Robbery with Homicide. However, the damages awarded shall be modified in keeping with People v. Jugueta. 1 The proper amounts of damages for robbery with homicide are: P75,000.00 as civil indemnity, P75,000.00 as moral damages, and P75,000.00 as exemplary damages. Thus, the award of moral damages in the amount of P75,000.00 and actual damages in the amount of P60,096.00 is maintained, but the amount of civil indemnity must be increased from P50,000.00 to P75,000.00. The Court also awards exemplary damages in the amount of P75,000.00. In conformity with prevailing jurisprudence, 2 legal interest at the rate of 6% per annum from the date of finality of this Resolution until full payment is imposed.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision 3 dated January 20, 2017 of the Court of Appeals in CA-G.R. CR-HC No. 07817 and AFFIRMS said Decision finding accused-appellant Ryan Salvador y Jasinillias GUILTY beyond reasonable doubt of the crime of Robbery with Homicide under Article 294 (1) of the Revised Penal Code, sentencing him to suffer the penalty of reclusion perpetua and to pay the heirs of Cristito Magallano P75,000.00 as moral damages and P60,096.00 as actual damages, subject to the MODIFICATION that the award of civil indemnity is increased to P75,000.00. In addition, exemplary damages in the sum of P75,000.00 is awarded to the heirs of Cristito Magallano. CAIHTE
The total damages awarded shall be subject to a legal interest of 6% per annum from the finality of this Resolution until its full satisfaction.
