People v. Salimbagat y Tuanda
This is a criminal case, *People of the Philippines v. Roque Salimbagat y Tuanda and Arnold Granton y Gante*, which was elevated to the Supreme Court after the Court of Appeals found the accused-appellants guilty of murder. However, the Supreme Court dismissed the appeal for failure of the appellants to prove any reversible error committed by the Court of Appeals. The appellants were sentenced to reclusion perpetua and were ordered to pay jointly and severally the heirs of the victim civil indemnity, moral damages, and exemplary damages, with the addition of six percent (6%) interest per annum from the time of finality of the resolution until fully paid.

Please take notice that the Court, Second Division, issued a Resolution dated06 June 2018which reads as follows: cHECAS
"G.R. No. 233249 (People of the Philippines vs. Roque Salimbagat y Tuanda, Arnold Granton y Gante and Rowen Deluvio y Abenita, accused; Roque Salimbagat y Tuanda and Arnold Granton y Gante, accused-appellants). — After an exhaustive review of the allegations, issues and arguments presented by the parties, the Court resolves to DISMISS the appeal for failure to sufficiently prove that the Court of Appeals committed a reversible error in its disputed Decision 1 dated April 6, 2017 in CA-G.R. CR-HC No. 01911 as to warrant the exercise of the Court's discretionary appellate jurisdiction.
WHEREFORE, the Decision dated April 6, 2017 of the Court of Appeals in CA-G.R. CR-HC No. 01911, finding accused-appellants Roque Salimbagat y Tuanda and Arnold Granton y Gante GUILTY beyond reasonable doubt of the crime of Murder, sentencing them to suffer the penalty of reclusion perpetua, and to pay jointly and severally the heirs of victim Pedrito Tuanda: 1) Php75,000.00 as civil indemnity; 2) Php75,000.00 as moral damages; and 3) Php75,000.00 as exemplary damages, is hereby AFFIRMED with MODIFICATION in that the accused-appellants are also ORDERED to PAY interest at the rate of six percent (6%) per annum from the time of finality of this Resolution until fully paid, to be imposed on the civil indemnity, moral damages, and exemplary damages.
