NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 01 February 2017 which reads as follows:
"G.R. No. 226154 — People of the Philippines v. Robert Ruiz y Miguel.
The records of this case were elevated to this Court on August 24, 2016, pursuant to the Resolution 1 of the Court of Appeals (CA), dated October 16, 2015, which gave due course to the notice of appeal filed by Robert Ruiz y Miguel (accused-appellant).
In its Resolution, 2 dated October 3, 2016, the Court directed both parties to submit their supplemental briefs, if they so desired. On November 8, 2016, accused-appellant filed his Manifestation (in Lieu of Supplemental Brief) 3 averring that he would adopt his Appellant's Brief filed before the CA. On November 22, 2016, the Office of the Solicitor General filed its Manifestation (in Lieu of Supplemental Brief) 4 stating that it was no longer submitting a supplemental brief as its Appellee's Brief had sufficiently ventilated the issues raised.
After a perusal of the records of the case, the Court resolves to dismiss the appeal for failure of accused-appellant to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the September 16, 2015 Decision of the Court of Appeals in CA-G.R. CR H.C. No. 06067 is AFFIRMED with MODIFICATION. The Court finds accused-appellant Robert Ruiz y Miguel GUILTY beyond reasonable doubt of the crime of Rape and sentences him to suffer the penalty of reclusion perpetua and to pay AAA civil indemnity, moral damages and exemplary damages in the amount of Seventy Five Thousand Pesos (P75,000.00) each.
Accused-appellant is ordered to pay legal interest on all damages awarded in this case at the rate of six percent (6%) per annum from the date of finality of this resolution until fully paid.
