NOTICE

Please take notice that the Court, Second Division, issued a Resolutiondated 29 September 2014 which reads as follows:
G.R. No. 208440: PEOPLE OF THE PHILIPPINES v. GENILO ROXAS ALIAS "MANONG"
Pursuant to the Court of Appeals resolution 1 dated March 7, 2013, the records of this case were elevated to this court on August 12, 2013. 2 The resolution gave due course to the notice of appeal 3 dated February 18, 2013 filed by accused-appellant.
In compliance with this court's resolution 4 dated September 25, 2013, accused-appellant 5 and the Office of the Solicitor General 6 separately manifested that they were no longer filing supplemental briefs as they had already stated their arguments in their respective briefs before the appellate court.
After an evaluation of the records of the case, this court resolves to DISMISS accused-appellant's appeal for failure to sufficiently show reversible error in the challenged decision warranting the exercise of this court's appellate jurisdiction.
WHEREFORE, this court ADOPTS the findings of fact and conclusions of law of the Court of Appeals in its decision dated January 29, 2013 in CA-G.R. CR-HC No. 05239, finding accused-appellant Genilo Roxas alias "Manong" GUILTY beyond reasonable doubt of rape under Article 266-A of the Revised Penal Code. The penalty of reclusion perpetua is AFFIRMED with MODIFICATION. The awards of civil indemnity are increased from P50,000 to P100,000, the moral damages from P50,000 to P100,000, and exemplary damages from P25,000 to P100,000 with legal interest of 6% per annum from the finality of this decision until its full satisfaction.
