NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated February 19, 2020, which reads as follows:
"G.R. No. 233101 (PEOPLE OF THE PHILIPPINES, plaintiff-appellee, v. REYNALDO ROSENDE y CANIETE, accused-appellant). — The Court of Appeals elevated the records of this case to this Court on August 18, 2017 1 pursuant to its March 7, 2017 Resolution, 2 which gave due course to the Notice of Appeal 3 filed by accused-appellant Reynaldo Rosende y Caniete.
In its September 18, 2017 Resolution, 4 this Court noted the records of this case forwarded by the Court of Appeals and required the parties to file their respective supplemental briefs.
In its February 7, 2018 Resolution, 5 this Court noted the Manifestations filed by accused-appellant 6 and the Office of the Solicitor General, 7 on behalf of plaintiff-appellee People of the Philippines, stating that they would no longer file supplemental briefs.
After an evaluation of the records of this case, this Court resolves to dismiss the appeal of accused-appellant for his failure to sufficiently show any reversible error in the assailed Court of Appeals Decision 8 as to warrant the exercise of this Court's appellate jurisdiction.
WHEREFORE, the Court of Appeals' January 31, 2017 Decision in CA-G.R. CR-H.C. No. 08136 is AFFIRMED. Accused-appellant Reynaldo Rosende y Caniete is found GUILTY beyond reasonable doubt of the crime of murder and is sentenced to the penalty of reclusion perpetua. He is also ORDERED to pay the heirs of the victim civil indemnity, exemplary damages, and moral damages worth P75,000.00 each, temperate damages worth P50,000.00, and the costs of suit. 9
All damages awarded shall be subject to interest at the rate of six percent (6%) per annum from the finality of this Resolution until fully paid. 10
