NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated9 August 2017which reads as follows:
"G.R. No. 229670 — People of the Philippines v. Andres Regalado y Bata.
The records of this case were elevated to this Court on February 21, 2017, pursuant to the Resolution 1 of the Court of Appeals (CA), dated May 18, 2016, which gave due course to the notice of appeal filed by Andres Regalado y Bata (accused-appellant).
In its Resolution, 2 dated April 3, 2017, the Court directed both parties to submit their supplemental briefs, if they so desired. On June 28, 2017, the Office of the Solicitor General filed its Manifestation (In Lieu of Supplemental Brief) 3 stating that it was no longer submitting a supplemental brief as its Appellee's Brief had sufficiently ventilated the issues raised. On July 5, 2017, the accused-appellant filed a Manifestation (In Lieu of Supplemental Brief) 4 averring that he would adopt his Appellant's Brief filed before the CA.
After a perusal of the records of the case, the Court resolves to dismiss the appeal for failure of the accused-appellant to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the February 29, 2016 Decision of the Court of Appeals in CA-G.R. CR H.C. No. 06738 is AFFIRMED. The Court finds accused-appellant Andres Regalado y Bata GUILTY beyond reasonable doubt of Qualified Rape and hereby sentences him to suffer the penalty of reclusion perpetua without eligibility for parole; to pay AAA civil indemnity in the amount of P100,000.00; moral damages in the amount of P100,000.00; and exemplary damages in the amount of P100,000.00. Accused-appellant is ordered to pay legal interest on all damages awarded at the rate of six percent (6%) per annum computed from the date of finality of this resolution until fully paid.
