Please take notice that the Court, Third Division, issued a Resolution dated August 16, 2017, which reads as follows:
"G.R. No. 192823 (People of the Philippines, Plaintiff-Appellee, v. Raquel Rayo y Cruz, Richard Balberde y Cruz, and Ronaldo Concepcion y Guzman, Accused; Richard Balberde y Cruz, and Ronaldo Concepcion y Guzman, Accused-Appellants) — After careful review of the records, the Court RESOLVES TO DISMISS the appeal for failure of the accused-appellants Richard Balberde y Cruz and Ronaldo Concepcion y Guzman to sufficiently show that the Court of Appeals committed any reversible error in upholding their convictions for the violation of Section 5 of Republic Act No. 9165 (Concepcion) and for the violation of Section 11 of Republic Act No. 9165 (Balberde).
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law made by the Court of Appeals in its assailed decision promulgated on December 17, 2009 in CA-G.R. CR-HC No. 02245, and AFFIRMS the decision finding:
(1) Accused-appellant RONALDO CONCEPCION y GUZMAN GUILTY beyond reasonable doubt of violating Section 5 of Republic Act No. 9165, and penalizing him with LIFE IMPRISONMENT and a FINE OF P500,000.00; and
(2) Accused-appellant RICHARD BALBERDE y CRUZ GUILTY beyond reasonable doubt of violating Section 11 of Republic Act No. 9165, and penalizing him with the indeterminate penalty of 12 years and one day to 15 years and one day of IMPRISONMENT and a FINE OF P300,000.00.
The accused-appellants are ordered to pay the costs of suit.
