NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated March 24, 2021 which reads as follows:
"G.R. No. 248950 (People of the Philippines v. Bayani Ramiro). — After a perusal of the records of the case, this Court resolves to dismiss the appeal 1 for failure of accused-appellant Bayani Ramiro to sufficiently show that the Court of Appeals erred in upholding his conviction for the crime of Murder defined and penalized under Article 248 of the Revised Penal Code.
On the award of damages, the Court modifies the same in keeping with the ruling in People v. Jugueta. 2 In that case, We held that in criminal cases such as Murder wherein the penalty imposed is reclusion perpetua, the damages to be awarded are civil indemnity, moral damages and exemplary damages in the amount of P75,000.00, respectively. Further, when no documentary evidence of burial or funeral expenses in court is presented, the amount of P50,000.00 as temperate damages shall be awarded.
WHEREFORE, the appeal is DISMISSED. The Decision dated January 17, 2019 of the Court of Appeals in CA-G.R. CR-HC No. 09900 is AFFIRMED with MODIFICATION in the following:
a. P75,000.00 as civil indemnity;
b. P75,000.00 as moral damages;
c. P75,000.00 as exemplary damages; and
d. P50,000.00 as temperate damages.
The award of damages shall likewise be subject to an interest of six percent (6%) per annum reckoned from the finality of this Resolution until full payment.
