NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedJuly 3, 2019which reads as follows:
"G.R. No. 234043 (People of the Philippines v. Raymundo Rabenitas y Valera). — The Court NOTES the letters dated February 12, 2019 and February 13, 2019 of CTSO2 Ramoncito D. Roque, Deputy Chief, Inmate Documents and Processing Division, and CSSupt. Gerardo F. Padilla, MPA, CSMS, Chief Superintendent, respectively, of the Bureau of Corrections, Muntinlupa City, informing the Court that accused-appellant Raymundo Rabenitas y Valera 1 died inside the New Bilibid Prison Hospital on October 21, 2018, as evidenced by the attached certified true copy of Rabenita's death certificate. 2
Death of the accused, pending appeal of his conviction, extinguishes his criminal liability as well as the civil liability based solely thereon. 3 Accused-appellant's death extinguished his criminal liability. On the other hand, there is no civil liability involved in violations of Republic Act No. 9165, otherwise known as the Comprehensive Dangerous Drugs Act of 2002. 4 HTcADC
Accordingly, the Court resolves to DISMISS the appeal of the late Raymundo Rabenitas y Valera for being moot and academic.
Let the case be considered CLOSED and TERMINATED.
