Sirs/Mesdames:
Please take notice that the Court, Third Division, issued a Resolution dated December 2, 2015, which reads as follows:
"G.R. No. 202682 (People of the Philippines v. Leonardo Palattao y Dogas). — Considering the allegations, issues and arguments presented in the appeal, the Court resolves to DISMISS the appeal for failure to sufficiently show that t11e Court of Appeals committed any reversible error in its assailed Decision dated September 23, 2011 as to warrant the exercise of the Court's appellate jurisdiction. HEITAD
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated September 23, 2011 of the Court of Appeals in CA-G.R. CR-HC No. 04409 and AFFIRMS said Decision finding appellant Leonardo Palattao guilty beyond reasonable doubt of three (3) counts of Murder, as defined and penalized under Article 248 of the Revised Penal Code, sentencing him to suffer the penalty of reclusion perpetua, for each count, and to pay the heirs of each of the victims, Julieto Talay, Romeo Pamittan and Domingo Bura, the amounts of P50,000.00 as moral damages, P50,000.00 as actual damages, P50,000.00 as civil indemnity and P30,000.00 as exemplary damages, with MODIFICATION by DELETING the interest on all damages awarded computed from April 28, 2006 (the date of killing of the victims) up to the finality of this Decision and, instead, IMPOSING interest on all damages awarded at the rate of 6% per annum from date of finality of this judgment until fully paid, in view of prevailing jurisprudence.
