Please take notice that the Court, Third Division, issued a Resolution dated December 2, 2015, which reads as follows: aScITE
"G.R. No. 202870 (People of the Philippines v. Tito Padel y Sabido). — After a careful review of the allegations, issues, and arguments presented, the Court resolves to DISMISS the appeal for failure to sufficiently prove that the Court of Appeals committed any reversible error in its assailed Decision dated May 27, 2011 as to warrant the exercise of the Count's discretionary appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated May 27, 2011 of the Court of Appeals in CA-G.R. CEB CR-HC No. 00745 and AFFIRMS said Decision finding accused-appellant Tito Padel y Sabido guilty beyond reasonable doubt of violation of Section 5, Article II of Republic Act No. 9165, and sentencing him to suffer the penalty of life imprisonment and ordering him to pay a fine in the amount of P500,000.00.
