NOTICE

Please take notice that the Court, Second Division, issued a Resolution dated 23 March 2015 which reads as follows:
"G.R. No. 214474 — People of the Philippines v. Jonnel T. Pacistol.
The records of this case were elevated to this Court on October 17, 2014, pursuant to the Resolution of the Court of Appeals (CA), dated June 19, 2014, which gave due course to the notice of appeal filed by the accused-appellant, Jonnel T. Pacistol.
The Court NOTES the Manifestation, dated January 29, 2015, filed by the Office of the Solicitor General, and Manifestation and Motion in Lieu of Supplemental Brief, dated February 11, 2015, filed by the accused-appellant, stating that they would no longer file their supplemental briefs and that they were adopting all the defenses and arguments raised in their respective briefs filed before the CA.
The Court DISMISSES the appeal of the accused-appellant for his failure to sufficiently show reversible error in the challenged decision warranting the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law of the Court of Appeals in its November 11, 2013 Decision in CA-G.R. CR-HC No. 05514, finding accused-appellant Jonnel T. Pacistol GUILTY beyond reasonable doubt of the crime of Robbery with Homicide, as defined and penalized under Article 294, paragraph 1 of the Revised Penal Code, as amended, and sentencing him to suffer the penalty of reclusion perpetua without eligibility for parole under Section 3 of Republic Act No. 9346, and to pay the heirs of the victim the amount Fifty Thousand Pesos (P50,000.00) as civil indemnity; Fifty Thousand Pesos (P50,000.00) as moral damages; Twenty-Two Thousand Three Hundred Pesos (P22,300.00) as actual damages; and to pay the costs of the suit. The accused-appellant is further ordered to pay interest on all monetary awards for damages at the rate of Six Percent (6%) per annum from the date of the finality of this resolution until fully satisfied.
